These Terms and Conditions (“Terms”) govern your use of our website, services, and the purchase, download, or use of any of our digital products, Standard Operating Procedure (SOP) templates, manuals, and compliance modules (collectively, “Products”).

By browsing this website, subscribing to our materials, or purchasing our products, you agree to be fully bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of this website and refrain from purchasing our products.

1. Professional Disclaimer & Limitation of Liability

Moncrieffe Quality Management Solutions provides pre-drafted regulatory frameworks, standard operating procedures, and quality management system templates designed in alignment with Good Distribution Practice (GDP) guidelines.

  • No Regulatory Guarantee: While our Products are engineered to meet rigorous industry standards, local regulatory requirements vary by jurisdiction. The purchase of a Product does not guarantee an automatic pass or compliance status during an official audit or inspection.
  • Responsibility for Customization: The Buyer acknowledges that these Products are frameworks. It is the sole responsibility of the Buyer to properly customize, validate, execute, and maintain the procedures to reflect their actual operational realities and local statutory laws.
  • Limitation of Liability: In no event shall Moncrieffe Quality Management Solutions, its directors, employees, consultants or registered pharmacists be held liable for any direct, indirect, incidental, or consequential damages, including but not limited to business disruptions, loss of inventory, regulatory fines, suspension of operating licenses, or audit failures experienced by the Buyer.

2. Digital Product Licensing & Intellectual Property

When you purchase a Product from this website, you are not purchasing the copyright to the text. Instead, you are purchasing a limited, non-exclusive, non-transferable, single-entity license to use the document.

Permitted Use:

  • You may download, edit, modify, and adjust the pre-written text, fonts, and layout of the template.
  • You may use the customized document internally for the operational and compliance needs of one (1) single business entity or facility.

Strictly Prohibited Use:

  • You shall not resell, redistribute, sub-license, share, or freely publish our templates, raw files, or access keys to third parties, external organizations, or competing businesses.
  • You shall not use a single purchase to deploy the templates across multiple separate corporate entities, sister companies, or multi-facility networks without purchasing additional corporate licenses.
  • Independent consultants or external auditors shall not purchase a single copy of a template to use, distribute, or modify for multiple distinct clients. A separate license must be purchased for each client entity.

Failure to comply with these restrictions constitutes a severe breach of copyright and intellectual property laws, resulting in the immediate termination of your license without a refund, and may subject the offender to legal action.

3. Digital Goods Sales & Refund Policy

Due to the digital nature of our Products, all templates, checklists, and modules are delivered instantly via download links or digital access keys upon successful payment.

  • All Sales Are Final: Because a downloaded digital asset cannot be physically “returned” or revoked, Moncrieffe Quality Management Solutions enforces a strict no-refund policy. Once a purchase is completed and the file or link is delivered, no refunds, exchanges, or store credits will be issued under any circumstances.
  • Chargeback Protection: The Buyer agrees not to initiate fraudulent credit card chargebacks. Moncrieffe Quality Management Solutions utilizes automated digital tracking logs that capture the exact timestamp, IP address, and success status of every digital file download. These logs serve as objective, binding proof of product delivery to payment gateways and financial institutions.

4. Updates, Access Keys, and Product Support

  • The 18-Month Update Guarantee: For eligible bundled packages, your purchase secures unrestricted digital access to all updates, structural modifications, supplementary records, and bonus templates added to that specific module for exactly eighteen (18) months from your initial purchase date.
  • Software Compatibility: Our templates are delivered as fully editable Microsoft Word (.docx) files and standard spreadsheet formats. Moncrieffe Quality Management Solutions is responsible for delivering uncorrupted files but is not responsible for troubleshooting the Buyer’s personal computer systems, third-party word processing software variations, or hardware compatibility.

5. User Conduct & Security

If you are issued an access key or create an account on our platform to download digital assets, you are entirely responsible for maintaining the confidentiality of your login details and credentials. You agree to immediately notify us of any unauthorized use or security breach regarding your digital delivery keys.

6. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of Jamaica, without giving effect to any principles of conflicts of law.

Any legal action, suit, or dispute arising out of or relating to these Terms, website use, or product purchases shall be settled exclusively in the courts of Jamaica, and the Buyer explicitly consents to the personal jurisdiction of such courts.
